NOTICE OF CALIFORNIA GUBERNATORIAL RECALL ELECTION AND AMENDED NOTICE OF TRUCKEE FIRE PROTECTION DISTRICT SPECIAL TAX ELECTION

NOTICE FROM THE NEVADA COUNTY CLERK-RECORDER/REGISTRAR OF VOTERS OF A GUBERNATORIAL RECALL ELECTION AND DATES WITHIN WHICH DECLARATIONS OF CANDIDACY MAY BE FILED. AMENDED NOTICE OF LOCAL TAX MEASURE T TO BE VOTED ON AT THE RECALL ELECTION. NOTICE OF EARLY VOTING. NOTICE OF CENTRAL TABULATION. NOTICE FOR OBSERVERS. NOTICE OF POST-ELECTION PROCEDURES.

NOTICE IS HEREBY GIVEN by Gregory J. Diaz, Nevada County Clerk-Recorder/Registrar of Voters, in accordance with the California Elections Code, that on Tuesday, September 14, 2021, there will be a California Gubernatorial Recall Election.

NOTICE IS FURTHER GIVEN that the California Gubernatorial Recall Election provides that this or a similar variation of the question “Shall GAVIN NEWSOM be recalled (removed) from the office of Governor?” shall appear on the ballots, followed by a second question that lists the names of the candidates nominated to succeed the Governor, should he be recalled.

NOTICE IS FURTHER GIVEN that official Nomination Petitions and Declarations of Candidacy for eligible candidates to replace Governor Gavin Newsom may be obtained from the Nevada County Elections Office at 950 Maidu Avenue in Nevada City, CA 95959, Monday through Friday from 8:00 a.m. to 5:00 p.m., excluding holidays. Candidates may obtain more information by calling the Nevada County Elections Office at 530-265-1298 or 1-888-395-1298.

NOTICE IS FURTHER GIVEN that candidate filing opens Friday, July 2, 2021, and will close Friday, July 16, 2021, after which time no Declarations of Candidacy may be accepted for filing.

NOTICE IS FURTHER GIVEN that the Measure T Special Tax Election called by the Truckee Fire Protection District that was originally scheduled as an all-mailed ballot election on August 31, 2021 is now consolidated with the Gubernatorial Recall Election. Both elections will take place on Tuesday, September 14, 2021. 

NOTICE IS FURTHER GIVEN that the ballot measure text for Truckee Fire Protection District Measure T is as follows:

Measure T:

“To reduce the risk of wildfire/improve wildfire prevention, including removing dry brush, dead trees, fuels and fire hazards; improving emergency evacuation systems, routes and procedures; supporting defensible space around homes, neighborhoods and critical infrastructure, providing more green waste disposal options; shall the Truckee Fire Protection District measure levying $179 per parcel for eight years be adopted, providing $3,700,000 annually in locally-controlled funding for wildfire protection, with independent audits, exemptions for low-income residents, and citizen oversight?”

NOTICE IS FURTHER GIVEN that at the Gubernatorial Recall Election the early voting period will begin on August 16, 2021. Vote centers will open on staggered schedules starting on September 4, 2021 and will offer in person voting from 8:00 a.m. to 5:00 p.m., including weekends. On Election Day, September 14, 2021, all vote centers will be open from 7:00 a.m. to 8:00 p.m.

NOTICE IS FURTHER GIVEN that after the polls close on September 4, 2021, ballots will be tabulated at the Nevada County Elections Office. The election results from each vote center will be delivered to the Nevada County Elections Office after the last voter in line has voted.

NOTICE IS FURTHER GIVEN that, in the event of a power outage and lack of access to back up power generation, tabulation may be moved to the Providence Mine Room located on the second floor of the Eric W. Rood Administrative Center, 950 Maidu Avenue, Nevada City, CA 95959.

NOTICE IS FURTHER GIVEN that per Assembly Bill 152, the Registrar of Voters hereby notifies all interested organizations that the verifying of signatures on Vote-By-Mail ballots cast for the Gubernatorial Recall Election will commence on August 16, 2021 or at any time thereafter in the Nevada County Elections Office. On August 16, 2021 or at any time thereafter, the opening and processing of Vote-By-Mail ballots will commence. This process will continue until all election results are tabulated and the election is certified. Any member of the County Grand Jury, and any other interested organization, shall be permitted to observe and challenge the way the Vote-By-Mail ballots are handled, from the processing of ballot return envelopes through the opening, counting and disposition of the ballots.

NOTICE IS FURTHER GIVEN that the canvass will commence on September 16, 2021 at the Nevada County Elections Office.

NOTICE IS FURTHER GIVEN, in accordance with provisions of the Election Laws of the State of California, that on September 16, 2021 at 10:00 a.m., the Nevada County Elections Office will randomly select precincts for a manual tally of one percent of the precincts casting ballots at the September 14, 2021 Gubernatorial Recall Election. This random selection of precincts will take place at the Nevada County Elections Office and is open to the public.

NOTICE IS FURTHER GIVEN that on September 20, 2021 at 10:30 a.m. the Nevada County Elections office will begin a manual tally of one percent of the precincts casting ballots at the September 14, 2021 Gubernatorial Recall Election. This manual tally is open to the public and shall continue daily (Saturdays, Sundays and Holidays excluded unless otherwise decided by the County Registrar of Voters) until completed.
