2017 Housing Ordinance Amendments (PLN17-0026; ORD17-1)

July 13, 2017 Planning Commission Public Hearing

On Thursday, July 13, at 1:30 p.m. the Nevada County Planning Commission will hold a public hearing to consider making a recommendation to the Board of Supervisors regarding proposed text amendments to the County's Zoning Ordinance, to bring the Code into compliance with State housing laws for accessory dwelling units (ADUs), and transitional and supportive housing. Background

On September 27, 2016, California Governor Brown signed two accessory (second) dwelling unit bills into State law, Assembly Bill (AB) 2299 and Senate Bill (SB) 1069, that amend the State's existing second unit law (Government Code Section 65852.2). Additionally, the County's adopted Housing Element (2014-2019) includes various ongoing implementation programs to provide equal opportunities for housing. Program EO-8.5.4 of the Housing Element requires the County to amend its zoning regulations, in accordance with California Senate Bill (SB) 2, to allow transitional and supportive housing as a residential use of property, subject to the same restrictions and permitting requirements that apply to other residential dwellings of the same type in the same zoning district.

The intent of the proposed amendments is to align applicable County housing regulations with California laws (PDF) aimed at reducing physical and financial barriers to constructing second units, and to further implement the County's Housing Element regarding transitional and supportive housing.
